Packtrail Terms of Service

These Terms of Service govern your use of the Packtrail mobile app. By using Packtrail, you agree to these terms.

1. The app

Packtrail is a mobile app that helps bikepackers and cyclists plan trips, bag setups, gear, weight, volume, packing status, trip templates, and pre-ride checklist tasks.

Packtrail is an offline-first planning and organization tool. It is not a navigation service, route planner, route tracker, weather service, emergency service, rescue tool, bike maintenance system, medical advisor, legal advisor, or professional safety advisor.

The app is provided by Novasas Thomi, Switzerland. References to "we", "us", or "our" mean the developer and operator of Packtrail.

2. Acceptance of these terms

By downloading, installing, accessing, or using Packtrail, you agree to these Terms of Service. If you do not agree, do not use the app.

You must use Packtrail only in compliance with applicable laws, app store rules, these terms, and any third-party terms that apply to your device, operating system, or store account.

3. Planning support only

Packtrail can support your preparation, but it cannot determine whether you, your bike, your bags, your equipment, your route, the weather, the terrain, or the current conditions are safe.

You are solely responsible for checking your gear, bike condition, route, weather, terrain, water and food needs, tools, lights, batteries, first aid, spare parts, clothing, shelter, communication options, local regulations, traffic rules, permits, and personal fitness before and during every ride.

Checklist items, templates, suggestions, weights, volumes, bag limits, packing status, progress indicators, readiness labels, and similar app output are for convenience only. They are not complete safety instructions and must not be treated as confirmation that a trip is safe or fully prepared.

You must independently verify all critical items before relying on them in the real world. For example, if a flashlight, front light, rear light, battery, medicine, water filter, repair tool, pump, spare tube, emergency blanket, navigation device, or other important item is missing, forgotten, discharged, unsuitable, or incorrectly packed, Packtrail is not responsible for resulting risk, delay, injury, loss, damage, accident, exposure, or other dangerous situation.

Always follow manufacturer instructions and limits for your bike, racks, bags, mounts, lights, batteries, electronics, camping equipment, tools, and safety equipment. Do not overload bags or the bike beyond real-world limits, even if entered app values appear acceptable.

4. Your content and inputs

You are responsible for the trips, bag setups, item names, weights, volumes, notes, templates, checklist entries, preferences, and other information you enter into Packtrail.

You must ensure that your inputs are accurate enough for your own use. Packtrail does not verify real-world item weight, volume, compatibility, durability, legal compliance, or safety.

You may not use Packtrail to store or create content that violates applicable law, infringes third-party rights, or is intended to support unlawful, unsafe, abusive, or harmful conduct.

5. Local data and backups

The core Packtrail workflow is designed to store trip, bike, bag, gear, packing, checklist, and preference data locally on your device.

If you uninstall the app, clear app data, reset your device, change devices, lose your device, or use operating system cleanup tools, local Packtrail data may be permanently removed.

Unless a backup, export, sync, or restore feature is clearly offered in the app or by your operating system, you are responsible for keeping any copies or records you need outside Packtrail.

6. Google Play and platform terms

If you download Packtrail from Google Play, Google's applicable Google Play terms, policies, billing rules, refund rules, and account terms apply in addition to these terms.

Google Play, Google, Android, your device manufacturer, your mobile network provider, and your operating system may provide services or controls that Packtrail relies on. Those third parties are responsible only under their own terms and policies.

The app stores are not responsible for Packtrail support except where their own terms require it.

7. Purchases and future premium features

Packtrail may offer premium features, a one-time purchase, subscription, trial, or another paid option in the future.

Where purchases are offered through Google Play or another app store, payment processing, taxes, refunds, cancellations, purchase restoration, family sharing eligibility, billing disputes, and account-based access are handled by the relevant store under its own terms.

Do not send full payment card numbers, passwords, one-time codes, or sensitive payment credentials to Packtrail support.

8. Third-party services and links

Packtrail may rely on operating system features, app store services, device storage, purchase APIs, sharing tools, browser links, support email, analytics, crash reporting, or other third-party services where available.

Third-party services may change, stop working, restrict access, process data, or be governed by their own terms and privacy policies. We are not responsible for third-party services, third-party content, or actions taken by third parties.

9. Availability, updates, and changes

We may update, change, suspend, restrict, or discontinue Packtrail or parts of Packtrail at any time, including features, templates, pricing, supported platforms, and store availability.

Some features may depend on your device, operating system version, store country, app permissions, release approval, internet availability, or third-party services.

You are responsible for installing app updates where needed. Older app versions may stop receiving support or may not work correctly with current operating systems or store services.

10. No warranties

Packtrail is provided as is and as available. To the maximum extent permitted by law, we disclaim all warranties, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, accuracy, reliability, availability, and non-infringement.

We do not guarantee that Packtrail will be uninterrupted, secure, error-free, complete, suitable for every trip, suitable for every bike or bag setup, suitable for outdoor safety decisions, or free from data loss.

We do not guarantee that templates, suggested items, checklist states, readiness indicators, weight calculations, volume calculations, or capacity information will prevent forgotten items, incorrect packing, overloading, unsafe riding, equipment failure, injury, accident, delay, or damage.

11. Limitation of liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, gear, profit, revenue, business opportunities, goodwill, outdoor plans, travel plans, or enjoyment arising from or related to Packtrail.

To the maximum extent permitted by law, we are not liable for injury, death, property damage, loss, delay, exposure, rescue cost, route error, traffic incident, weather-related harm, equipment failure, forgotten gear, missing safety equipment, missing light or flashlight, missing medication, missing repair item, missing food or water, or any other real-world consequence of using, not using, or relying on Packtrail.

Nothing in these terms excludes or limits liability, warranty rights, or consumer rights that cannot legally be excluded or limited under applicable law.

12. Indemnity

To the extent permitted by law, you agree to defend, indemnify, and hold us harmless from claims, losses, liabilities, damages, costs, and expenses arising from your misuse of Packtrail, your violation of these terms, your violation of law, your content or inputs, or your infringement of third-party rights.

13. Termination

You may stop using Packtrail at any time by deleting the app from your device.

We may suspend or end access to Packtrail or related services if required by law, required by app store rules, needed for security, caused by discontinuation of the app, or connected to material violation of these terms.

14. Changes to these terms

We may update these terms when Packtrail changes, store requirements change, legal requirements change, or our business changes.

The Last updated date shows when these terms were revised. Continued use of Packtrail after updated terms become available means you accept the updated terms, unless applicable law requires another form of notice or consent.

15. Governing law

These terms are governed by the laws applicable in the country or region of the developer listed in the Google Play listing or other applicable app store listing, unless mandatory consumer protection laws in your country or region require otherwise.

If any part of these terms is found unenforceable, the remaining parts continue to apply to the maximum extent permitted by law.
